Criminal Forfeiture

Criminal forfeiture is an asset forfeiture proceeding litigated inside the criminal case. If the indictment contains a "forfeiture notice" it is a criminal forfeiture proceeding.

  • When people not charged with the criminal offense own an interest in the seized property, they are "third parties." Third parties are not allowed to participate in the criminal trial or pretrial proceedings until after someone is convicted in the case. If there is no conviction there can be no criminal forfeiture. After conviction, third parties whose property is targeted for criminal forfeiture have separate proceedings, decided by the judge without a jury.
